Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and services (collectively, the "Service") provided by Rightmynd ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Not Investment Advice

The Service provides educational and informational content relating to options market structure, gamma exposure, and related analytics. The Service does not provide investment, tax, legal, or other professional advice. You should consult with qualified professionals before making any financial decisions. See our Disclaimer for additional information about the nature of the Content provided.

3. Account Registration

Some features of the Service require registration. You agree to provide accurate, current, and complete information during registration and to keep your credentials secure. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

4. Subscription Plans and Payments

The Service offers both free and paid subscription plans. Paid plans are billed in advance on a recurring basis (monthly or annually, as selected). By subscribing to a paid plan, you authorize us and our payment processor (Stripe) to charge the payment method on file on each renewal date.

Subscriptions automatically renew until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by law.

We reserve the right to change pricing at any time. Price changes will take effect at the next billing period and will be communicated to you with at least 14 days' notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Scrape, mirror, resell, or republish Service data or content without our prior written consent (the underlying market data is licensed from third parties with their own restrictions);
  • Attempt to reverse-engineer, decompile, or otherwise access the Service's source code or underlying infrastructure;
  • Share your account credentials with others or allow multiple people to use a single account;
  • Use automated tools (bots, crawlers, scrapers) to access the Service at a frequency or volume that exceeds normal human usage;
  • Interfere with or disrupt the Service, servers, or networks connected to the Service;
  • Upload or transmit viruses, malware, or any other malicious code.

6. Intellectual Property

The Service, including all software, content, graphics, designs, and the compilation of data, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

7. Third-Party Data

Market data, options data, and other financial data displayed on the Service are provided by third-party data providers. We are not responsible for any errors, delays, interruptions, or inaccuracies in data provided by third parties. Your use of such data may also be subject to the terms of the relevant data provider.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that the Service will be error-free, secure, or continuously available.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total cumulative liability to you for any and all claims arising out of or related to the Service shall not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim, or (ii) USD $100. Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless us, our officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination will survive, including limitations of liability, indemnification, and governing-law provisions.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English, on an individual basis. You waive any right to participate in a class action or class arbitration.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the Service at least 14 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
